General Terms and Conditions of Sale (GTCS)

1. General Information

These General Terms and Conditions of Sale (hereinafter the “GTCS”) apply to all contracts concluded via the website www.pharmalp.ch, owned by:

2. Scope

These GTCS govern all contractual relationships between Pharmalp SA (hereinafter “Pharmalp”) and its customers regarding the sale of health products on the website www.pharmalp.ch.

Placing an order implies full and unconditional acceptance of these GTCS.

Customers are defined as:

• Individuals (private persons acting in a personal capacity)
• Businesses (individuals or legal entities acting for commercial purposes)

Pharmalp reserves the right to modify the GTCS at any time. The applicable conditions are those in effect at the time of the order.

3. Products

The products are those displayed on the website www.pharmalp.ch, subject to availability.
Descriptions are as accurate as possible, but images are non-contractual.
Pharmalp reserves the right to modify its product range at any time.

4. Orders

The presentation of products on the site does not constitute a legal offer. The order placed by the customer constitutes a purchase offer.
The contract is concluded once the payment is validated. A confirmation is then sent by email.

5. Prices

Prices are indicated in Swiss francs (CHF), including VAT.
Shipping costs are added depending on the order amount (see section “Delivery”).
Pharmalp reserves the right to change its prices at any time.
The prices charged are those displayed at the time of the order.

6. Use of Vouchers and Promotional Codes

Promotional vouchers issued during marketing campaigns, as well as purchased gift vouchers, can be used during the checkout process on www.pharmalp.ch.

The specific conditions stated on each voucher apply, including:

• Validity date
• Minimum purchase amount (if applicable)
• Excluded products or categories
• Single or multiple use

Vouchers cannot be exchanged for cash. No refund will be given for unused amounts. In the case of fraudulent use, Pharmalp reserves the right to cancel the order.

7. Delivery

General Conditions
• Delivery is available exclusively within Switzerland.
• Shipments are handled by Swiss Post.
• No deliveries are made on official public holidays in the canton of Valais.

Processing Times
If the ordered products are in stock, your order will be prepared and packed as quickly as possible. Our team commits to processing orders within 3 business days.
Orders received after 5:00 p.m. are considered as received the next business day.

Exceptional Closures
If specific information is displayed on the website (e.g., via a banner or notice) indicating a temporary closure or inability to ship during a given period, that information will prevail. In such cases, order processing will resume at the end of the announced period.

Shipping Costs
Orders ≥ CHF 40 (incl. VAT): free shipping
Orders < CHF 40 (incl. VAT):

• Standard (economy) delivery: CHF 7
• Priority delivery: additional CHF 2

Shipping fees for partners (healthcare professionals with a validated account)

Orders ≥ CHF 100 (incl. VAT): Free delivery
Orders < CHF 100 (incl. VAT):

• Standard (economy) delivery: CHF 7
• Priority delivery: additional CHF 2

Pharmalp may make partial deliveries at no additional cost to the customer.

8. Payment

Accepted payment methods:
• Credit cards (Visa, Mastercard)
• Twint

Charges are processed upon order validation. Pharmalp is not responsible for any associated bank fees.

9. Product Inspection and Transfer of Risk

The customer must inspect the products within 3 business days of receipt and immediately report any defects.
Without such a claim, the products are deemed accepted.
The risk transfers to the customer upon receipt of the products.

10. Right of Withdrawal

Private customers have a right of withdrawal within 3 days of receiving the order, without needing to justify their decision.
Products must be returned within 7 days, in perfect condition, unopened, and in their original packaging. Return shipping costs are the responsibility of the customer, except in the case of an error by Pharmalp.

Upon return, products may be exchanged, refunded, or credited toward a future invoice.

11. Deficiencies / Warranty

The legal warranty applies in accordance with Swiss law.
Pharmalp recommends consulting a doctor in the case of potential intolerances or allergies.

12. Data Protection

The privacy policy is an integral part of these GTCS.
By validating their order, the customer also agrees to the privacy policy.

13. Disclaimer

Pharmalp strives to ensure the availability and proper functioning of its website and the quality of the products offered. However, the company cannot be held liable for technical errors, temporary service interruptions, or inaccurate content.
Pharmalp assumes contractual liability only in the event of a breach of contractual obligations and solely in cases of gross negligence or intentional misconduct. Liability for indirect, consequential damages or loss of profit is expressly excluded, within the limits provided by law.

Specifically, Pharmalp disclaims any liability:

• For damage caused by improper use of the products
• In the case of allergies, intolerances, or side effects related to product consumption
• For delays or delivery failures due to force majeure events (strikes, natural disasters, administrative decisions, etc.)

By using the website www.pharmalp.ch, the customer expressly accepts this limitation of liability.

14. Governing Law and Jurisdiction

Swiss law applies.
The place of jurisdiction is Sion (Valais).
For any disputes or legal proceedings, the competent court will be that of the canton of Valais.
The contractual language is French.
These GTCS are governed by Swiss law.

15. Severability Clause

If certain articles or paragraphs are found to have no legal effect, or if the contract contains one or more gaps, the rest of the contract remains applicable, excluding the affected articles or clauses.
